1. General provisions
These Terms govern access to the EvoPay service (wallet, payments, and escrow) on the VirtuOZ platform. The Operator is EvoPay LLP (BIN 240440034473).
By using the service, you agree to these Terms, the public offer, the Privacy policy, and applicable laws of the Republic of Kazakhstan. If these Terms and the public offer conflict on service delivery, the public offer prevails.
2. Definitions
- Platform — VirtuOZ: the web interface, API, and related services through which EvoPay operates.
- User — an individual or legal entity with an account.
- Buyer / Depositor — the party that places funds in escrow.
- Seller / Beneficiary — the party that may receive the funds.
- Wallet — the User’s fund ledger on the Platform.
- Escrow — conditional holding of funds until agreed conditions are met.
- Transaction — the parties’ terms and operations through escrow on the Platform.
- Fee — the Operator’s charge; shown before an operation is confirmed.
3. Registration and identification
To use the service you must:
- be at least 18 years old (for individuals);
- provide accurate and up-to-date information;
- complete identification (KYC) as required by the product and AML/CFT law;
- not share account access with third parties;
- use the service only for lawful purposes.
The Operator may restrict or terminate access for breach of these Terms, inaccurate data, or suspected unlawful activity.
4. Services
EvoPay provides:
- wallet and payment operations;
- escrow;
- dispute review under Platform rules;
- user support.
The Operator is not a party to the deal between Users and does not determine the quality of goods, works, or services. Current information on the Operator’s status, licensing, and supervision is in the Operator’s documents, at registration, and with support.
5. Escrow
The parties record the subject, amount, timelines, and payout or refund conditions. The Buyer places funds in escrow; they remain unavailable until there are grounds for payout or refund. After fulfillment is confirmed, funds are paid to the Seller (minus any applicable fee); if refund grounds apply, funds are returned to the Buyer. Details are in the public offer.
6. Disputes
A dispute is opened in the cabinet with evidence. The Operator reviews materials within the timelines in the public offer and may pay out, refund, allocate in part, or refer the parties to further resolution. The Operator’s escrow decision does not remove the parties’ right to go to court under Kazakhstan law.
7. Fees
- Fees and the total amount are shown before confirmation.
- Who pays the fee follows the deal rules and tariffs.
- Fees are non-refundable unless required by law.

8. Prohibited use
You must not use the service for money laundering or terrorist financing, prohibited goods, fraud, intellectual-property infringement, deception, or sanctions evasion. The Operator may report suspicious operations to authorised bodies.
9. Intellectual property
Software, design, text, and marks of the Platform belong to the Operator or rights holders. Copying and reverse engineering without permission are prohibited.
10. Limitation of liability
The Operator is not liable for:
- the quality of performance between Users;
- delays by banks or payment channels;
- indirect or incidental damage.
The Operator’s maximum liability to a User is limited to the fees received from that User in the last 12 months, unless a higher amount is required by law.
11. Indemnity
The User will indemnify the Operator for losses caused by the User’s breach of these Terms.
12. Changes
These Terms may be updated; the “Last updated” date changes accordingly. We notify Users of material changes via the Platform and/or email. Continued use after publication means acceptance, unless law requires otherwise.
13. Suspension and termination
Access may be restricted for breach of these Terms, AML/CFT risks, or an order of an authority or court. Open escrow cases are resolved under the public offer and the disputes section.
14. Governing law
The laws of the Republic of Kazakhstan apply. Disputes not resolved pre-trial are heard in court at the Operator’s location, unless consumer-protection law gives another choice.

16. Final provisions
This document is available in several languages; if versions conflict, the Russian text prevails. By using EvoPay, you confirm acceptance of these Terms.
